General provisions

The electronic web shop of Pick&Go bvba, hereinafter referred to as "the Vendor", offers its customers the possibility of ordering/reserving food and drinks from various merchants. The present General Terms and Conditions ("Conditions") apply to all the articles in the range and to every purchase that the Customer places with pickandgo.be

Any order is considered as acceptance by the Buyer of our general conditions, which form an integral part of the agreement, to the exclusion of all other general or special conditions emanating from the Buyer, unless expressly stipulated otherwise in writing.

Pick&Go bvba reserves the right to refuse an order in the event of certain irregularities or suspicion of dubious orders or buyers.

Price

All prices stated include VAT and all other taxes that the customer is required to pay. If transport, reservation or administrative costs are charged, this will be indicated separately.

The price stated refers exclusively to the articles as described word for word in the product description. The accompanying photo is for decorative purposes only and may contain elements that are not included in the price.

For all orders, the prices valid on the website on the day will be charged.

For registered and express shipments, additional charges apply (only on request).

All prices on the website are subject to printing and typesetting errors and Pick&Go bvba cannot be held liable for any printing and typesetting errors.

Pick&Go bvba reserves the right to change prices on the website when price changes occur.

Offer

The articles are intended exclusively for normal private use.

Despite the fact that the catalogue and website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date. If you have specific questions about, for example, sizes, colours, availability, delivery period or method, we request that you contact our customer service department beforehand (see article 12).

As for the accuracy, up-to-dateness or completeness of the information offered, Pick&Go bvba is only bound to a best-efforts obligation. In no event can Pick&Go bvba be held liable in the event of material, typing or printing errors.

The offer is always valid while supplies last and can be modified or withdrawn by Pick&Go bvba at any time.

Pick&Go bvba is authorised - without stating any reasons - to refuse orders, adapt the terms of delivery, split up deliveries, or attach other conditions to the delivery.

Online purchases & payment

Pick&Go bvba uses the following payment methods for online purchases: Visa, Mastercard, Bancontact/Mister Cash and bank transfer. Orders will only be prepared for shipment when the full purchase amount + shipping costs are on our account.

When a bank transfer is chosen as the payment method, the products are reserved for the Buyer for a period of 7 days. If, after 7 days, the purchase amount and the shipping costs are not in Pick&Go bvba's account, the purchase will be cancelled for the Buyer in question. If he/she still wishes to purchase the product, the normal online purchasing procedure will have to be set up again.

Retention of title

The delivered goods shall remain our property until full payment of the price, including all costs and charges, interest on arrears and compensation. In the event of non-payment, we reserve the right to take back the goods, by operation of law and at the expense of the Buyer. However, the risk of loss or damage shall pass to the Purchaser upon delivery.

Penalties for non-payment

Invoices are payable at our registered office on the due date, net without discount, unless otherwise indicated on the invoice.

In order to be admissible, any complaint concerning invoices must be made in detail by registered letter within three (3) days of receipt of the invoice.

In the event of late payment, interest will be charged on the outstanding invoice amounts at a rate of 1% per month from the invoice date, ipso jure and without any prior notice of default being required. In the event of non-payment and if a reminder sent by normal post has not been effectual within 14 days, fixed damages amounting to 10% of the outstanding amounts shall also be payable.

We reserve the right in the event of each complete or partial non-payment of an invoice on the due date or any other breach by the Buyer of his obligations under the agreement, automatically and without notice of default, to suspend the execution of all agreements with the Buyer or to terminate them with immediate effect, without the need for any judicial intervention, and to demand immediate payment of all claims, even those not yet due, or to make the delivery only in exchange for cash payment, notwithstanding previous agreements and without prejudice to any other rights we may be able to enforce.

Failure to take immediate action against a shortcoming on the part of the Buyer may under no circumstances be regarded as a waiver on our part of the right to invoke this shortcoming at a later date.

Delivery

Delivery takes place as long as stocks last.

Products are only delivered in the countries for which the website allows delivery.

We strive to deliver the package to the Buyer the next day, provided that the Buyer makes his order and payment before 12 noon, except on weekends. The target delivery day will be indicated in the confirmation e-mail. The delivery times are indicative and are not firm deadlines. Exceeding of any delivery period does not give the "buyer" any right to compensation or the like.

Normally, all products listed on our website are in stock, unless otherwise indicated.

Should there be an abnormal delay due to force majeure or other circumstances, either at our premises, at our suppliers premises or due to strikes, we will inform you immediately, together with concrete information on the delivery time involved.

Delivery times mentioned for some products are only an indication of when the product in question is expected again.

We do not guarantee and are not responsible for delays by our suppliers or transport companies.

Should it happen that a product is suddenly sold out due to a large sale and you have ordered it, we will immediately inform you of the probable delivery date. Should it happen that we are unable to deliver the ordered product within 30 days after the order date, you will receive an e-mail from us after 30 days with the right to cancel the order free of charge. The amount already paid will be refunded within 14 days without interest or other compensation.

NOTE: If you order several products, your parcel will only leave if all the products are in stock. If your parcel cannot be delivered within 14 working days, we will send the out of stock product to you separately and free of charge as soon as it is back in stock. Unless it is an article with a different delivery time mentioned on the website!

Pick&Go bvba is not responsible for damage of any kind, due to incorrect and/or incomplete data provided by the "buyer". Erroneous delivery addresses are the responsibility of the "purchaser" and may give rise to additional costs that will be borne by the "purchaser".

The risks of transport are for Pick&Go bvba and are transferred to the purchaser at the moment that your order is received by you or on your behalf.

Damaged or lost shipments

Defective or damaged goods on delivery.

If the products you have ordered arrive at your home in a faulty or damaged condition, you must notify us immediately by e-mail. This must be done within 7 days!

Afterwards you will receive further instructions from us via e-mail and/or telephone in order to solve this as soon as possible.

If damage is already visible on delivery, check the contents immediately in the presence of the delivery person. If something is damaged to the product itself, you have the right not to accept the shipment and you can return the shipment to the delivery person without additional costs.

If damage is not reported to us within 7 days, Pick&Go bvba reserves the right to refuse the exchange, as well as returns of a dubious nature.

All products arrive from our suppliers and are checked personally by us for errors, defects and damage. Also the functioning of products with batteries, products that need to be plugged in or that work with USB and suchlike are thoroughly tested first. This way, we can send you the products you have bought with confidence. We will always pack them well.

Lost shipments.

Shipments sent by Pick&Go bvba that are lost: if your shipment, "after confirmation from us that it has been sent", has still not arrived within 7 days for Belgium and within 10 days for other countries, please send us an e-mail with your order number, name, telephone number and e-mail address. This way we can first find out what happened to your shipment. (Always take into account any public holidays, extended weekends and any strikes in the transport sector). If your shipment is lost, we will send you a new shipment without charge.

Customer returns that are lost: the customer remains responsible for the return. We cannot be held responsible for returns that are lost. If you want to be sure that your return reaches us, it is best to work with an authorised transport company or Taxipost and make sure that your parcel is sufficiently stamped and well wrapped. In case of loss the right for reimbursement expires.

Complaints

You can send us complaints about the delivery, the quality, the nature of the product or any other complaint by e-mail. Pick&Go bvba will then contact you within 7 working days to try and resolve the complaint as quickly as possible.

Satisfaction guarantee

Every customer is equally important and that is why we make every effort to ensure that the sale, shipment and handling are as quick as possible and excellent. If you are not satisfied or if you have a complaint, please send us an e-mail and we will try to resolve it as soon as possible. Even after the sale, shipment and handling, we remain at your disposal! You can always mail or call us for any question or information. Service after the sale is just as important to us!

Warranty

In order to invoke the guarantee, the customer must be able to present proof of purchase.

For articles purchased online and delivered to the customer's home, the customer must contact our customer service department beforehand, after which the customer must return the article to Pick&Go bvba at his/her own expense.

Any defect needs to be reported within 7 days after its discovery. Afterwards, any right to repair or replacement expires.

The commercial and/or legal guarantee is never applicable to defects that arise as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance.

It is also not applicable to articles with a shorter lifespan, or wear items. Defects that become apparent after a period of 14 days following the date of purchase, or delivery if applicable, are not considered to be hidden defects, unless the customer can prove otherwise.

Term of forfeiture

The provisions of this article apply only to customers who purchase items online in their capacity as consumers:

The consumer has the right to notify the company that he/she is cancelling the purchase, without having to pay a penalty and without having to state a reason, before the start of production of the ordered item.

Customers who wish to make use of the right of renunciation must contact our customer service within 14 days of delivery and return the goods at their own expense within 20 days of delivery to Pick&Go bvba, Sportstraat 226, 9000 Ghent, Belgium.

Goods with a sales price of 100 euro or more must be returned to us by courier (DHL, FedEx, DPD, etc.).

Only items that are in the original and undamaged packaging, together with all accessories, instructions and invoice or proof of purchase can be returned.

Under no circumstances will the following articles be taken back: used, dirty or incomplete articles, articles of which the packaging (or part of the packaging) has been opened, articles that have been custom-made for the customer, articles that cannot be returned due to their nature.

Force majeure

In the event of force majeure, Pick&Go bvba has the right, at its own discretion, to suspend the execution of an order, or to dissolve the agreement without any judicial intervention. Pick&Go bvba will inform the "purchaser" of this, without Pick&Go bvba being liable for any compensation. The full purchase price paid will be reimbursed within 14 days.

Cases of force majeure may include: strike, lock-out, war, fire, water damage, theft, burglary, revolution, mobilisation, epidemics, supplier default, production interruptions, collective labour disputes, illness, weather conditions, production problems or other similar circumstances.

Pick&Go bvba cannot be held liable in any way for not being able to deliver orders placed in the event of force majeure.

Communication

Pick&Go bvba is in no way liable for any misunderstandings, damage, delays or failure to clearly transmit orders and communications as a result of the use of internet or any other means of communication in traffic between the "purchaser" and Pick&Go bvba, or between Pick&Go bvba and third parties, insofar as it relates to the relationship between the "purchaser" and Pick&Go bvba.

Privacy

If you place an order with Pick&Go bvba, your details will be included in Pick&Go bvba's customer file.

Your data will be processed in accordance with the applicable laws and regulations.

Pick&Go bvba will never pass on or sell your data to third parties. Pick&Go bvba respects the privacy of all the users of its site and makes sure that the personal information you provide us with is treated confidentially. The information we need from you is only to ensure that your purchase and shipment go smoothly and that we can contact you if necessary. These data always remain internal and are not used for other purposes. Only the transport companies used will receive your name and address for the shipment.

If you subscribe to our newsletter, your data will remain internal and confidential and we will only use your data for our newsletter, promotional offers and special actions. If you no longer wish to receive newsletters you can unsubscribe at any time.

If you want to delete your account, send us an e-mail with your details and we will remove you from our customer database.

If you create an account with Pick&Go bvba, we keep your data on a secure server. In your Pick&Go bvba account, we store information such as your name, address, phone number, email address and delivery details, so that you do not have to enter them with every order.

In accordance with the law of 08/12/1992 on processing personal data, the buyer has a legal right to inspect and correct his personal data.

Cookies: Cookies are pieces of information that your web browser stores on your computer. Pick&Go bvba only uses cookies to recognise you at your next visit. Cookies cannot be used to identify individuals. You can set your computer so that you do not accept cookies on Pick&Go bvba, but it is possible that you will encounter problems during the ordering process. Cookies allow us to collect information about the use of our services and to improve and adapt them to the wishes of our visitors.

Attack on validity - non-waivers

If any provision of these Terms and Conditions is declared invalid, unlawful or null and void, this will in no way affect the validity, lawfulness and applicability of the other provisions.

The failure at any time by Pick&Go bvba to enforce any of the rights listed in these Terms and Conditions, or to exercise any of them, will never be considered a waiver of such provision and will never modify the validity of these rights.

Amendment of Terms and Conditions

These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to, and the general conditions of sale of Pick&Go bvba. In the event of any contradiction, these Terms and Conditions will prevail.

Pick&Go bvba can amend these Terms and Conditions at any time, without further notice. Any purchase made after the amendment constitutes acceptance by the customer of these new Terms and Conditions.

Intellectual and industrial property rights

The contents of this website, including the name Pick&Go bvba, the brands, logos, photos, product and company names, texts, drawings, images, information, etc. are protected by intellectual rights and belong to Pick&Go bvba and/or entitled third parties. Nothing can be used without prior and express authorisation.

Intellectual and industrial property rights resting on the products provided by Pick&Go bvba are fully and unconditionally respected by the purchaser. Pick&Go bvba does not guarantee that the products supplied to the purchaser do not infringe on any (unwritten) intellectual and/or industrial right of ownership of third parties.

Limited liability

The contents of this website, including the brands, logos, photos, product and company names, texts, drawings, images, information and so on are protected by intellectual rights and belong to Pick&Go bvba and/or entitled third parties. Nothing can be used without prior and express authorisation.

Client declares that, by using and making available any images and/or other materials through the website www.pickandgo.be in order to purchase a product, he/she does not infringe on any intellectual rights and/or privacy interests of third parties.

The Client indemnifies Pick&Go bvba without reservation of any claims that any other person may address to Pick&Go bvba regarding infringement of the rights of a third person, in particular copyright, which is established through the use of data provided by the Client.

Proof

The customer accepts that electronic communications and backups may serve as evidence.

Applicable law - Competent court

Belgian law applies, with the exception of the provisions of international private law on applicable law and with the Rome I Regulation on international sales contracts concerning movable goods. In the event of any dispute, only the courts in the district of Pick&Go bvba's registered office are competent, even if there are several defendants..
